I came across a website using my image (http://www.gradydorn...or.com/suwanee/)

Sent them the following note:

 

I came across your website tonight (http://www.gradydorn...or.com/suwanee/) and noticed you are using one of my images.  While I am honored you found the image so pleasing that you decided to use it on your website, it does cause an issue.  First, the image is being used without permission from the copyright holder, which is me.  Second, no photo credit has been given to the copyright holder.  Third, no request for a limited license use has been requested.

 

I would be happy to discuss how you can continue to use this image for your website.  Please contact me so we can work toward an agreement.

Here is my response to his e-mail back to me:

 

Grady, I am hopeful that we can work out an agreement to allow for continual use of the image on your site.  Below are several options you can chose from depending on your current and future needs:

o    Image can NOT be offered for sale

o    Image can NOT be given to other parties

Sent them a message and received this as a response:

Our apologies as we had no clue. This photo was on the City of Suwanee Facebook Page and we did ask permission as we thought it was THEIR photo, not yours, and we were given permission. 

 

I will remove this picture from the document. It was only emailed out on the PDF flyer as you saw. That's the only place we used it. Where do we go from here as we were under the impression it belonged to the City Of Suwanee.

Sent this to the City of Suwanee:

 

XXXXX, I am coming across my image being used by multiple commercial entities and other 3rd parties.  On their website, PDF mailers, and even in physical locations.   Some of these places have just flat out stole the image.  However, one of them responded that the City of Suwanee gave them permission to use it.  Now I know I gave the City of Suwanee the right to use the image when I entered it into the Snap Suwanee photo contest, but that license can’t be transferred to a 3rd party without my permission. 

 

Not a single use, other than the City’s, that I have found gave me photo credit or reached out to me to obtain a license for using the image.  In the event someone would like to use any of my images, I would be more than happy to work out an agreement. 

 

I have been a resident of Suwanee since for over 20 years and love the city.  I also love that my images are being used by the City and would gladly give them to the City for their use, even outside of the Snap Suwanee contest.  However, I can’t allow commercial entities or other 3rd parties to have unlimited use of my images.  I hope you can understand and would be happy to talk in more detail with you.

My response back to the Color Race people:

 

Thanks for the quick response.  I will contact the City of Suwanee.  They do have the right to use my image, they just can’t transfer that right to a 3rd party without receiving my permission.

 

I do love seeing my image in use, but I hope you understand that allow it to be freely used without my permission.  If you would like to discuss how you can use the image, I would be happy to discuss it with you.

I am truly sorry. If I had known, I would have contacted you. To make it up to you, for the 2016 race, Can we add your business to our race as an In-kind Donation for the usage of your picture from this race?

Looks like the first site (http://www.gradydorn...or.com/suwanee/) has removed all the images from that page.  So far, I have not received a response from the e-mail with my pricing, interesting.
